GENERAL TERMS AND CONDITIONS FOR ISSUING AND USING THE HERALDI FOR MEN BENEFITS CARD
According to the general terms, the conditions for using the Heraldi for Men Benefits Card, issued by Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia (hereinafter: "Benefits Card")), are specified. The cardholder must be an individual over 18 years of age who has completed the Enrollment Statement and confirmed all mandatory information indicated in the statement, agreeing to the terms. If the individual is of legal age and willing to accept the general terms of use, Diversus Res d.o.o. will issue the Heraldi for Men Benefits Card based on the previously provided Enrollment Statement.

CARD The Heraldi for Men Benefits Card provides additional advantages that can be utilized when shopping at Heraldi for Men stores. It is issued in accordance with these General Terms and Conditions for Issuing and Using the Heraldi for Men Benefits Card (hereinafter: "Terms"). A list of stores where the cardholder can obtain and use the Heraldi for Men Benefits Card is available on the website www.heraldi.hr and at the sales locations themselves.

HOLDER The Heraldi for Men Benefits Card is issued to individuals over the age of 18 upon completion of the Enrollment Statement (all mandatory fields must be filled out) at any Heraldi for Men retail location.
By completing the Enrollment Statement (all mandatory fields must be filled out), an individual becomes the holder of the Heraldi for Men Benefits Card and guarantees the accuracy of the personal information provided during registration. By signing the Enrollment Statement, the individual confirms that has read and agrees to these Terms and Conditions. The issuer will send the Heraldi for Men Benefits Card to the holder within 30 days of completing the Enrollment Statement. Upon issuance of the card, the holder becomes a user of the Heraldi for Men Benefits Card. Membership is voluntary and free of charge, and any member can stop using the benefits by sending a request to terminate membership.
One individual can receive only one Heraldi for Men Benefits Card based on the provided personal information. The Heraldi for Men Benefits Card is non-transferable and may only be used by the holder. To verify card ownership, Diversus Res reserves the right to request the cardholder to present personal identification when utilizing the additional benefits provided by the Heraldi for Men Benefits Card.

THE ISSUER AND MANAGER of the Heraldi for Men Benefits Card is Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia (hereinafter: “Issuer”). By signing the Enrollment Statement, the holder of the Heraldi for Men Benefits Card confirms that is familiar with the General Terms and Conditions and agrees that Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, may collect personal data in accordance with these Terms. Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, commits to collecting, processing, protecting, and using the cardholder's personal data in accordance with these Terms and applicable regulations of the Republic of Croatia, as well as relevant European Union regulations on personal data protection (Directive 95/46/EC of the European Parliament and of the Council of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (CELEX 31995L0046).

PERSONAL DATA By signing the Enrollment Statement (all mandatory fields must be filled out), the cardholder consents to the processing of personal data and guarantees the accuracy of the personal information provided in the Enrollment Statement (name, surname, address, country of residence, and gender) and purchase details to Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, as the data controller for the Heraldi for Men Benefits Card, for the purposes defined by these Terms and the Croatian Personal Data Protection Act. The personal data collected by Diversus Res d.o.o. from the prospective cardholder includes: name, surname, residential address, country of residence, gender, date of birth, email address, and telephone number. In addition to this personal information provided during the Enrollment Statement, Diversus Res d.o.o., with the cardholder's consent, collects and processes data regarding purchases made by the cardholder at Heraldi for Men retail locations, as specified in sections 4 and 5 of these Terms.
The data controller collects and processes the following purchase information indicated on the receipt: business and store location of the purchase, date and time of purchase, product EAN code, product name, discount, quantity, price, VAT, total purchase amount, payment method, and salesperson. The EAN code on the receipt provides detailed information about the purchased product, including product type, product group, product size, product color, and brand. This data is used to analyze purchasing habits and generate indicators that help determine the profile of each Heraldi for Men Benefits Card user, allowing Diversus Res d.o.o. to prepare personalized offers.
5.
PERSONAL DATA PROCESSING Diversus Res d.o.o. will link voluntarily provided and signed data with purchase and transaction information. All data will be stored in the database at Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia. All personal data, as well as purchase information, will be regularly analyzed. The issuer will use this data for segmentation, preparation of tailored/individual offers, studying consumer habits, surveying, granting additional benefits, and direct marketing. The contact information of the Heraldi for Men Benefits Card holder will be used to notify about promotional offers and other activities at Heraldi for Men retail locations. The data controller may combine the personal data of the cardholder with data from other cardholders and process it for the aforementioned purposes.
Providing data is voluntary. However, if the data subject does not wish to provide the personal data deemed mandatory by the data controller, they cannot become a holder of the Heraldi for Men Benefits Card. Data about the Benefits Card holders may be forwarded to contracted data processors of the data controller, who process personal data on behalf of and for the data controller.
Contracted processors include companies that send SMS/MMS messages to holders, printing companies, and companies that maintain the software and databases of the data controller. Each applicant—holder of the Heraldi for Men Benefits Card, by signing the Application Form, confirms that is informed about the aforementioned purposes and methods of processing personal data and gives explicit consent for such processing. The holder can, at any time, in writing or in another manner prescribed by the Rules, request Diversus Res d.o.o. to permanently or temporarily cease using their email address or phone number for direct marketing purposes. The issuer of the Heraldi for Men Benefits Card is obliged, within 15 days of receiving such a request, to prevent further use of the holder’s personal data for direct marketing purposes and to inform the holder in writing or in another manner (e.g., via email) within the next 5 days.
The holder can continue to use all the benefits of the Heraldi for Men Benefits Card even after the cessation of using their email address or phone number for direct marketing purposes. If the holder requests the cessation of the use of all their personal data for direct marketing purposes, such a request will be interpreted as a request to terminate the use of the Heraldi for Men Benefits Card, and this request will be honored by deregistering the holder from the database of Heraldi for Men Benefits Card holders. Upon deregistration from the benefits card database, the issued Benefits Card will cease to be valid in Heraldi for Men retail locations.
Diversus Res d.o.o. or the contracted data processor may retain the holder’s personal data for up to 5 years after the contract termination, and data about individual purchases for at least 6 years after each purchase.
6.
CONDITIONS AND LIMITATIONS FOR USING BENEFITS To use the benefits, the Cardholder must present the Heraldi for Men Benefits Card at the point of sale when purchasing goods. Once payment for the goods has been made, it is not possible to retroactively register the purchase or apply any discounts. The Heraldi for Men Benefit Card is not valid during seasonal sales or on products that are already discounted. Discounts cannot be combined. However, the value of the discounted products purchased is added to the Cardholder's total purchase value. In the event of technical problems or force majeure that prevent the functioning of the computer system at Heraldi for Men stores, and consequently the use of the Card, Diversus Res d.o.o. is not liable for any damages that may arise for Cardholders on this basis.
7.
ADDITIONAL BENEFITS The Heraldi for Men Benefits Card offers its holders various short-term benefits that are individually tailored based on the personal and/or transactional data of each holder. These benefits are communicated to the holders via phone, SMS/MMS messages, regular mail, or email.
8.
DATA CHANGE In case that the Cardholder of the Benefits Card changes personal data provided in the Access Statement, has to undertake to notify the Benefit Card Issuer of the data change within 30 days from the date of the change, by sending a letter to the registered office address of Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, or by sending a message to the email address: heraldi@heraldi.hr.
9.
REPLACEMENT OF THE CARD Loss or theft of the Card can be reported by Cardholders via mail directly to the issuer's headquarters at Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, or by email to heraldi@heraldi.hr. The issuer will send a new Benefits Card to the Cardholder within 60 days of receiving notification of the Cardholder's personal data change. All benefits associated with the lost or stolen Benefit Card will be transferred to the new Card within 15 days of reporting. The issuer will immediately block the old Benefits Card upon receipt of notification of its loss or theft. In the event that the Card is misappropriated, the issuer does not assume responsibility for unauthorized use of benefits by third parties.
10.
TERMINATION OF MEMBERSHIP The Heraldi for Men Benefits Card is valid until a written revocation by the Issuer or upon receipt of a statement from the Holder requesting the termination of the use of the Heraldi for Men Benefits Card. The Holder may, at any time, by written declaration sent by mail to the address of the Issuer's headquarters as specified in the preceding section of these Rules, or by email to heraldi@heraldi.hr, request that Diversus Res d.o.o., Frankopanska 6, Zagreb, Croatia, stops using personal data in the manners and for the purposes specified in that statement, thereby ceasing to use the benefits of the Heraldi for Men Benefits Card and waiving the right to the Card and all benefits arising therefrom. Despite the termination of the Holder's benefits, the personal data manager may retain some data about the Holder for a maximum of five years (general statute of limitations) after the termination of membership. If no purchases are made with the Heraldi for Men Benefits Card within two years, it automatically becomes an inactive card. The Issuer reserves the right to cancel such a Benefits Card without prior notice to the Holder.
11.
PUBLICATION OF RULES These Rules come into effect on the day of their publication on the website www.heraldi.hr/. The Issuer reserves the right to make subsequent amendments to these Rules and to cancel the Heraldi for Men Benefits Card. All changes are publicly announced on the website www.heraldi.hr/and come into effect on the day of their publication. If the Holder of the Heraldi for Men Benefits Card continues to use the Benefits Card after such announced changes, it signifies their agreement and acceptance of the same.
